David DeFrieze is the current owner and lead consultant for DeFrieze Consulting and Programs, LLC (dba Federal Contracts Consulting).

David’s background is as an innovative acquisition professional providing broad experience across Government acquisition and corporate legal support. His proven ability to successfully attack extremely complex and unprecedented issues is why he was chosen for many special assignments and projects. David has served as lead counsel for many high dollar complex acquisitions and provides extensive experience with

  • contract interpretation, contract administration and compliance, project execution, teaming arrangements, fraud and false claims, public/private partnerships, and source selections/proposal evaluations involving IT, services, weapon systems, logistics support, contingency support, environmental, and cyber/intelligence.

David's management and leadership experience ranges from Chief Counsel of U.S. Army Research, Development, and Engineering Command overseeing six legal offices and 90+ attorneys and support staff to Special Counsel, Army Contracting Command, to Deputy Chief Counsel for BAE Systems OSI ensuring the highest quality legal support, business judgement, and regulatory compliance.

David is an experienced speaker and trainer on a variety of topics including contracts, source selection, teaming, contract cyber security, services contracting, contractor ethics, civilians and contractors on the battlefield, LOGCAP, and government-contractor conflict management.

David's focus is on mission success, and understands that effective, efficient, and ethical execution involves more than just compliance and zealous defense of position but requires collaboration and cooperation with external project and strategic partners. Success is as much about managing the working relationships as well as the legal relationships. His proactive approach to resolving complex challenges provided him with the opportunity to serve as lead Agency negotiator with states, communities, and industry on many unprecedented actions and disputes involving hundreds of millions of dollars.

    The guidebook provides a series of processes to be used on large complicated inter-organizational projects or programs to manage conflict, improve success, and avoid conflict and litigation. The tenants of this model have been used in hundreds of DOD large dollar acquisition programs. As stated on the Defense Acquisition University (DAU) website "This Guide prepared by the Army Materiel Command provides the acquisition community with a tool that can maximize the potential for achieving contractual objectives. This tool is called Partnering. Partnering is a commitment between government and industry to improve communications and avoid disputes. It is accomplished through an informal process with the primary goal of providing American soldiers with quality supplies and services, on time, and at a reasonable price."

  • Defining and Regulating the Weaponization of Space

    The debate over weaponizing space is complicated by inability to define what space weapons are except for those that pose a substantial danger to humanity, namely weapons of mass destruction. Past that brief moment of clarity, it becomes pointless trying to limit technological advance. More is accomplished influencing and regulating state behavior. Peaceful disputation can be convincing and can slow or halt escalation, but present international accords do not offer enforceable ways of handling claims regarding harmful space activity. The existing forum depends on diplomacy, leaving the need for a standing committee with the stature, knowledge, and fairness to regulate, monitor, and adjudicate, ideally the United Nations, helped by the economic deterrence and enforcement powers of the World Trade Organization.
